Supreme Court should not waste time on issues like gay marriage in the country: Jain Muni's letter to President

New Delhi: A heated debate is going on in the Supreme Court on the demand for recognition of gay marriage. At the same time, the central government and religious leaders are opposing it. Now Jain society has also opposed same-sex marriage. Jain Acharya Shiv Muni has expressed his opposition to this by writing a letter to President Draupadi Murmu. They have demanded that same-sex marriage should not be given legal recognition. He said that at a time when India is facing many problems, there is no need to discuss such a topic (homosexuality). Jain Muni has described poverty eradication, access to education to all, pollution free environment and population control as the main problems. 

 

Acharya Shiv Muni said that the Supreme Court has not shown any promptness on such problems. Describing India as a country of different religions, castes and sub-castes, he wrote that for centuries there has been recognition of marriage between a biological man and a biological woman, in such a situation, the institution of marriage is not only a union of two opposite sexes, but also for human progress. Mentioning the ancient definitions, he said that this has been the belief of marriage in all religions.

Jain Muni, referring to the earlier decisions of the apex court, said that the rights of homosexuals have already been protected (by removing section 377). He said that the matter of same-sex marriage may be of statutory right and not fundamental, but it is not a fundamental right and it can be protected only by enacting a law by the Parliament. Jain Muni objected to putting it under the Special Marriage Act, saying that it is for men and women, in such a way each and every provision of it will have to be defined in new forms.

He has written in his letter to the President that, "Marriage is a social/legal institution. Now neither it can be destroyed nor its new form can be coined. Marriage in India has had a civilizational significance and is a great institution that has stood the test of time. In independent India, work is being done to impose western practices on it. Instead of completing the pending cases, the time of the Supreme Court is being wasted on an imaginary subject. it is unfair."
