New Delhi: In the Income Tax case related to National Herald, the top court will hear today i.e. on Monday. Actually, the court has approved the Income Tax Department to continue the tax assessment of Sonia Gandhi and Rahul Gandhi. However, the court had said that the Income Tax Department cannot take any action till further orders. The court had said that the Income Tax Department can do tax assessment of both the leaders in the 2011-12 financial year, but the decision was not given on when to apply it.
Apart from Sonia and Rahul Gandhi, Congress veteran Oscar Fernandez was also sent a notice of tax investigation for 2011-12 by the Income Tax Department. The three leaders filed a petition against the validity of the notice. The interim order of the court was opposed by Solicitor General Tushar Mehta, saying that instead of taking the next date, the order should be issued on this day. Senior Congress leaders and lawyers Kapil Sibal and P. Chidambaram, on behalf of Sonia and Rahul Gandhi, presented the favor.
Earlier, Sonia, Rahul and Fernandes had challenged the validity of the notice in the Delhi High Court which was rejected and the road to tax assessment was cleared. The charge of the Income Tax Department was that Congress leaders have taken over Associated Journals Limited by forgery. BJP leader Subrahmanyam Swamy has filed a criminal complaint against the Congress leaders in Delhi's trial court, whose investigation is on. Sonia and Rahul Gandhi are currently on bail in this case.
