New Delhi: The Supreme Court has agreed to hear the practice of polygamy and Nikah-Halala prevalent among Muslims. The court has said that a bench of 5 judges will be constituted on this matter, which will look into the whole matter in detail and decide. In fact, a petition has been filed in the apex court against cases like polygamy, Nikah Halala, and mut'ah, and a ban has been sought on such malpractices. 

Chief Justice (CJI) DY Chandrachud has told that a constitutional bench is being constituted in this matter, which will hear the matter soon. The court has taken this decision on a petition filed by petitioner Ashwani Kumar Upadhyay. The petitioner has termed practices like polygamy, Nikah Halala, and mut'ah as anti-constitutional. In fact, the matter was heard by a five-judge bench on August 30 last year, but two judges of this bench, Justice Indira Banerjee and Justice Hemant Gupta, have retired.

In this case, advocate Ashwini Upadhyay, while filing an affidavit, demanded the constitution of a bench of 5 judges. Right now a bench of CJI DY Chandrachud and Justice PS Narasimha is hearing in the apex court. Chief Justice Chandrachud said it was an important issue pending before a five-judge bench. 

It has been said in the petition that in Nikah-Halala, a divorced Muslim woman has to first marry another man. After this, under Muslim personal law, one has to get a divorce to remarry her first husband. In such a situation, physical and mental harassment happens to many women. On the other hand, polygamy is the practice of having more than one wife or husband at the same time.
