Big decision of Supreme court on reservation, says 'court orders to state governments….'

New Delhi: The top court has given a big decision today on reservation. The Supreme Court of the country has said that it is not a fundamental right to demand reservation in government jobs and no court can order the state government to provide reservation to SC or ST. The court has said that it is entirely the right of the state government to decide whether it wants to provide reservation in jobs or reservation in promotion.

The court said that there is no compulsion on the state government to give reservation nor is it compulsory. However, the court has made it clear that if a reservation is to be given, the state government must collect data on the representation of SC and ST in government jobs. The state government is not obliged to give reservation in any way.

The court said that there is no fundamental right of this kind under which reservation can be claimed. For this, no such order can be issued by the court, in which the state government is asked to give reservation. The judgment was delivered by a bench of Supreme Court judges Justice L Nageswara Rao and Hemant Gupta.
