New Delhi: Former Delhi University professor GN Saibaba has received a major setback from the Supreme Court in the Maoist link case. The apex court, in a special hearing today, suspended the October 14 order of the Nagpur bench of the Bombay High Court, acquitting Saibaba and others. The Supreme Court also rejected Saibaba's demand for house arrest. The court said it cannot be accepted as he has been found guilty of a serious offence. The matter will now come up for further hearing on December 8.

The Supreme Court held that the sanction to prosecute the accused in the case under the provisions of the Unlawful Activities (Prevention) Act (UAPA) was illegal. Hours after the HC order, the Maharashtra government approached the Supreme Court seeking a stay on the verdict. Setting aside the life sentence awarded to Saibaba by the lower court, the high court held that terrorism was a threat to national security.

At the same time, the High Court held that heinous acts of terror generate collective social anger and suffering. Saibaba takes the help of a wheelchair due to his physical disability. The court has said that Saibaba should be released immediately unless his custody is required in any other case. But, now the Supreme Court has refused to release him too.
