ESMA Act comes into force in Uttar Pradesh, know what?

Lucknow: The Yogi government (UP Government) of Uttar Pradesh has once again enacted the ESMA Act (ESMA-Essential Services Maintenance Act) in the state. Under this Act, a strike has now been banned in UP for six months (Ban on Strike in UP). In fact, Additional Chief Secretary Personnel Dr. Devesh Kumar Chaturvedi has issued a notification in this regard. A notification said that strike is being banned in any public service, corporations, and local authorities related to state activities in Uttar Pradesh. Even then, action will be taken against those who go on strike under legal arrangements.

ESMA was installed in the state earlier also due to corona. On 25th November 2020, the UP Government took a major decision and implemented the Essential Services Maintenance Act for 6 months amidst the corona epidemic. Meanwhile, any strike was completely imposed in the state. Government employees involved in essential services under ESMA cannot go on any strike within the stipulated time. On the other hand, strict action will be taken if any employee ignores the rules. You must be aware that in May this year, the UP government had banned the strike for six months.

CM Yogi had banned the strike by enacting the AIIMSA Act in view of the problems faced by Covid and at that time the government had taken this step to speed up the prevention and vaccination drive of the corona. Talking about the AIIMS Act, it is designed for the protesters and the strikers. After its implementation, demonstrations or strikes are completely banned anywhere in the state. The Act was enacted by the UP government last year and it was said that even after the ESMA Act if an employee is found to be on strike or protest, legal action is taken by the government by arresting the striking persons without a warrant for violating the Act.
