New Delhi: The Delhi High Court on Thursday (February 24) refused to entertain an indictment application seeking registration of an FIR against various Bharatiya Janata Party (BJP) leaders for allegedly making inflammatory speeches during the anti-Hindu riots in Delhi in 2020. On this, the high court said that this petition will not be kept pending for the future. The court was hearing an intervention application filed by a lawyer in a pending case filed by Sheikh Mujtaba Farooq, who had sought registration of an FIR and a probe against BJP leaders Anurag Thakur, Kapil Mishra, Parvesh Verma and Abhay Verma. According to advocate Pawan Narang, who appeared on behalf of the counsel who filed the petition, the petitioner Farooq does not have the power to file a petition as a verdict of the top court said that the Public Interest Litigation (PIL) of those who have not even gone to the police should be turned down. A bench of Justices Siddharth Mridul and Anup Jairam Bhambhani refused to entertain the prosecution application. However, the matter will come up for hearing again on Monday (February 28). The court will continue to hear another batch of petitions seeking an independent SIT probe into the 2020 Delhi riots. It may be recalled that in December last year, the Supreme Court had asked the Delhi High Court to decide "within three months" the pending petition seeking registration of an FIR against BJP leaders Kapil Mishra, Anurag Thakur, Parvesh Verma and Abhay Verma. The Delhi Police, which is probing the northeast Delhi riots, had informed the Delhi High Court in July 2020 that it had not found "actionable evidence" to show that these leaders had any role in the riots.
