Govt to introduce Bill in R.S to promote, facilitate mediation

New Delhi: The Union government is planning to submit the 'Mediation Bill, 2021' in Rajya Sabha on Friday to encourage and facilitate mediation, particularly institutional mediation, in the wake of the ongoing Opposition outcry that has been disrupting Parliament proceedings on a regular basis.

Union Minister Kiren Rijiju is expected to introduce the bill, which aims to resolve commercial and other disputes, enforce mediated settlement agreements, and establish a body to register mediators. The bill's goal is to promote community mediation and make online mediation a viable and cost-effective option.

The Ministry of Law and Justice released a draught of the Mediation Bill, 2021 for public opinion and review on November 5 this year. Following India's adoption of the United Nations Convention on International Settlement Agreements Resulting from Mediation (Singapore Convention), the Bill aims to solidify mediation's status as a preferred means of alternative dispute resolution in the country.

The bill is divided into four sections, with Part I dealing with domestic mediations and Part III covering Singapore Convention mediations. Domestic mediation has been described as one performed in India, when all or both parties habitually reside in, are incorporated in, or have their business in India, according to Section 2 of the Bill.
