Patna: The Rouse Avenue court has authorized Tejaswi Yadav to travel to Dubai for a family vacation, despite being an accused in a CBI case. Tejaswi had requested permission to visit Dubai from September 18 to October 8 with his family. Special CBI Judge Vishal Gogne approved the request but imposed conditions on the travel. Tejaswi Yadav must provide a Fixed Deposit Receipt (FDR) for Rs 25 lakh, which will be forfeited to the Government of India if he violates any conditions set by the court. Additionally, he is required to submit his travel itinerary, details of his stay in Dubai, and a contact number to the court before departing. He must also provide a mobile number for contact during his stay abroad. Upon his return, Tejaswi must inform the court within 48 hours and surrender his passport after its renewal. He is prohibited from requesting an extension of his stay abroad. The CBI opposed the travel request, arguing that the allegations against Tejaswi, under Sections 13(2) r/w 13(1)(d) of the Prevention of Corruption (PC) Act, are serious. However, Special Judge Gogne noted that the gravity of the allegations alone is not sufficient to deny foreign travel to an accused on bail. The court dismissed the CBI’s objection, stating that the right to travel is fundamental and should not be unduly restricted. It emphasized that while travel details must be provided, overly stringent monitoring of personal travel plans is unwarranted. The court also noted that Tejaswi Yadav, as the Leader of the Opposition in Bihar, has no indication of absconding. The CBI’s concerns regarding the necessity of the trip and specific travel details were acknowledged but did not override the court’s decision. Tejaswi Yadav’s counsel argued that there was no risk of absconding and that reasonable restrictions on travel were acceptable. The court’s order reflects a balance between respecting the fundamental right to travel and ensuring compliance with legal obligations.
