MP by-election: Election Commission gets relief from Supreme Court, bans MP High Court order

New Delhi: The country's largest court on Monday stayed the Madhya Pradesh High Court order that political parties should campaign online instead of holding direct rallies for the November 3 assembly by-election in view of the global epidemic coronavirus.

Justice A.M. A bench led by Khanwilkar asked the Election Commission of India (EC) to take appropriate decision on political rallies keeping in view the coronavirus guidelines and law. The Petitions of the Commission and Madhya Pradesh Energy Minister Prayumna Singh Tomar were being heard in the Supreme Court challenging the October 20 order of the High Court. The apex court asked senior advocate Mukul Rohatgi, who was present on behalf of Tomar, to tell the election commission how much time has been wasted due to the High Court order.

In the backdrop of the High Court order, the election commission said that it is the responsibility of overseeing the conduct and management of elections under the Constitution and there is a ban on judicial meddling in the middle of the electoral process under section 329 of the Constitution.
