'You are not above law,' HC outraged over Kerala govt violating its order

Kochi: The Kerala High Court on Monday directed the state government to take action against illegal flag pole-bearers beyond their affiliation and said, "No one, even those in power, is above the law.'' Justice Devan Ramachandran said, "It doesn't matter how big a person you are, the law is above you.'' The judge said those in power, who understand the laws and the government, should be held more accountable.

The high court's remarks came after it noticed that the Kerala government had violated its order not to install flag poles illegally in the state anymore. Justice Ramachandran questioned the government saying, 'I have nothing to do with the colour of the flag, here it is red. This is a blatant violation. We can understand if the general public or those who are not in power or those in the Opposition do it, but should the people in power do it?'

Justice Ramchandran also said that some people have tried to connect them with a particular party and describe them as "federal," but neither they nor the High Court can be bowed down to such attempts. The high court was hearing a case related to the encroachment of public land. In another case, where a cooperative society has alleged that a particular political party is illegally putting up flags and banners on its land, the state government told the court that action is being taken by some district magistrates against illegal flag pole-bearers in the state and others will do the same. The court will hear the matter next in January.
