"Sports betting should be legal, damages caused by restrictions" Law Commission

The Law Commission on Thursday recommended that betting on other sports including cricket should be allowed as regular tax payable under direct and indirect tax systems. Also, use it as a source to attract foreign direct investment (FDI). In the report of the Commission 'Legal Framework: Gambling and Sports Betting Including Cricket in India', for the regulation of betting and to make tax revenue from it, some amendments have been recommended in the law.

The report says, "Parliament can make an ideal rule for the regulation of betting and the state can adopt it or alternatively Parliament can make a bill using its rights under Article 249 or 252 of the Constitution. If the bill is passed under Article 252, other states other than the agreed states will be free to adopt it."

The Commission also recommends for linking the Aadhar or PAN card of any person involved in betting or gambling and for cashless transactions to prevent the use of black money. This report has been prepared by Chairman Justice BS Chauhan. The Supreme Court had asked the BCCI and the Bihar Cricket Association to prepare a report on the possibility of legalizing betting during the hearing of the ongoing case. 

In the report of the Commission, the Mahabharata examples have also been taken. It has been said, "It is argued that if there was a rule regarding gambling in the time of Mahabharata, then Yudhishthira could not put his brothers and wife on the stake, probably not in Mahabharata"

It has been said in the report that such activities should be operated from India and valid license should be given to it. Betting and gambling activities are also recommended for linking to the Aadhar or PAN card and transaction cashless connectors. According to the 2010 KPMG report, the Indian speculative market is close to $ 60 billion but the latest figure is much larger than that.
