SC seeks Centre's reply on Facebook's plea over linking social media accounts with Aadhaar

Several high courts in the country have been facing a case of linking social media accounts like Facebook with Aadhaar since last year. Facebook has now sought transfer of these cases to the Supreme Court. Facebook says it may delay the decision due to separate cases in different courts. So it is better to hear the whole case in the Supreme Court.

For your information, three petitions linking Facebook and WhatsApp accounts with Aadhaar numbers are in the Madras, Bombay and Madhya Pradesh High Court. Facebook has said that 4 such cases are going on in different high courts. On the issue, Kapil Sibal, on behalf of WhatsApp, said that the policy cannot be fixed by the High Court as it falls within the jurisdiction of Parliament. He said all the cases should be heard in the Supreme Court.

In his statement, Sibal said that the main issue is WhatsApp, which deals with policy and is related to citizens across the country. He further said that the supreme court should hear the case and issue an order on the matter. It should not be that the High Court issues some orders and then challenges it in another court.
