New Delhi: Adish C. Aggarwala, the former president of the Supreme Court Bar Association (SCBA), has called for the current SCBA President, Kapil Sibal, to either retract a controversial resolution passed on August 21, 2024, or issue a public apology to all SCBA members. Failure to meet these demands could lead to a no-confidence motion against Sibal.

In his letter to Sibal, Aggarwala expressed serious concerns regarding a resolution related to the tragic rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata. The resolution, which described the incident as a "symptomatic malaise" and suggested such incidents are commonplace, has been criticized by Aggarwala for undermining the gravity of the case.

Aggarwala contends that the resolution was not officially approved by the SCBA's Executive Committee, rendering it invalid. He accuses Sibal of using his position to diminish the seriousness of the incident and of exhibiting a conflict of interest, given his representation of the West Bengal government in related cases.

The letter demands that Sibal retract the resolution and issue a public apology within 72 hours. If these demands are not met, Aggarwala warns that a no-confidence motion against Sibal may be initiated.

Aggarwala further criticizes Sibal for attempting to influence the Supreme Court and the ongoing investigation into the RG Kar Medical College case by issuing the resolution. He argues that this action has damaged the credibility and integrity of the SCBA President's role and has negatively impacted the medical and legal communities.

Several members of the SCBA Executive Committee have also voiced concerns over the resolution issued by Sibal. They allege that the resolution, dated August 21, 2024, was circulated on SCBA letterhead without proper approval or presentation to the Executive Committee.
