New Delhi: The court on Wednesday reprimanded the Army while hearing a petition in the Supreme Court seeking permission for women candidates to appear for the National Defence Academy (NDA) examination. During the hearing, the Army defended itself saying it was a policy decision on which a bench of Justices Sanjay Kishan Kaul and Hrishikesh Roy said the policy decision was based on "gender discrimination."

The court then passed its interim order directing women to appear for the National Defence Academy (NDA) examination scheduled for September 5 and said admissions would be subject to the final order of the court. The petition said that eligible women candidates with 10 2 level education are not given a chance to appear for NDA and Naval Academy examinations on the basis of their gender.
The court continued that while male candidates pursuing 10 2 level education equally get a chance to join the NDA to undergo training to be appointed as permanent commissioned officers in the Indian Armed Forces after appearing for the examination and qualifying. This is a clear violation of the fundamental right to equality of opportunity in matters of public employment and the fundamental right to protection from bias on the basis of gender.
