Bihar's 22,000 Teachers Face Job Uncertainty as B.Ed Appointments Ruled Invalid; Nitish Govt Moves to Supreme Court

Patna: After the Patna High Court invalidated the appointment of B.Ed-qualified teachers in primary schools, approximately 22,000 teachers in Bihar face the jeopardy of losing their jobs. In response to this, the Nitish government has offered some respite to these teachers. The government is set to appeal to the Supreme Court in support of primary teachers with B.Ed qualifications. The state government plans to file an appeal soon against the High Court's ruling, and officials from the Education Department are seeking advice from legal experts in this matter.

According to reports, the Education Department has resolved to approach the Supreme Court regarding the employment status of teachers holding B.Ed degrees in primary schools. The department has obtained preliminary consent in this regard and aims to present its case in favor of the teachers to the Supreme Court. With their jobs at risk following the Patna High Court decision, these teachers are hopeful that the Supreme Court will provide them with relief. However, if the Supreme Court does not rule in their favor, their appointments may be rescinded.

It's noteworthy that the Patna High Court delivered its judgment on December 6, declaring the appointment of B.Ed-qualified teachers in primary schools as invalid. The court deemed the 2018 notification issued by the National Council for Teacher Education (NCTE), which considered B.Ed degree holders eligible to teach children from class 1 to 5, as incorrect.

The Patna High Court based its decision on a previous Supreme Court order, which stipulated that only teachers with a Diploma in Elementary Education (D.El.Ed) or an equivalent diploma could be appointed for primary classes. Candidates with B.Ed degrees were deemed ineligible for such positions. Currently, around 22,000 teachers with B.Ed degrees in Bihar are teaching in primary schools.
