Shakti Mills gang rape case: Bombay HC says convicts don’t deserve to be ‘assimilated’ in society

Mumbai: The death sentence of three defendants in the gang rape of a woman photojournalist at Mumbai's Shakti Mill premises on August 22, 2013 has been converted to life imprisonment by the Mumbai High Court. The sessions court had already condemned three of the defendants to death and another to life in prison. The three defendants had taken their case to the high court after the sessions court's decision. The case resulted in the death sentences of Mohammed Salim, Mohammad Qasim Hafiz Sheikh aka Qasim Bengali, and Vijay Mohan Jadhav. In the same incident, Siraj Rahman Khan was sentenced to life in jail. Chand Babu, another defendant, was a minor at the time of the crime.

On November 25, 2021, the Bombay High Court issued its decision. According to accounts in the media, the court handed down its decision and expressed regret. 'The death sentence extinguishes the spirit of the prayed,' according to the court. Those who have been charged with a crime deserve to be forgiven for the rest of their lives. They will never be able to perpetrate a crime like this again in society. As a result, the perpetrators should face the death penalty. In the same shakti mill in 2013, there were two incidences of gangrape. The first was with a photojournalist, and the second was with a telephone operator. In both cases, the trial was underway at the same time. The telephone operator lawsuit included Mohammad Ashfaq Sheikh and Jadhav JJ as defendants. Jadhav JJ was a minor at the time when Mohammad Ashfaq Sheikh was condemned to life in jail. Involved in the case were Mohammed Salim, Mohammed Qasim, and Vijay Mohan Jadhav.

At 6.45 p.m. on August 22, 2013, a magazine women photographer was gang raped at Shakti Mill Compound. Mahalaxmi is home to Shakti Mill Compound. At 6 p.m. on the day of the occurrence, the defendants present in the shakti mill premises stopped the lady journalist and her accomplice. He informed the officers personally and requested that they come in and obtain permission from the officer before snapping the photograph. After dragging the couple inside, they assaulted and bound the lady journalist's companion. They had both saved their lives and arrived at the hospital after being gang raped for two hours. During the course of the inquiry, all of the defendants were apprehended within three days. After being released from the hospital on September 4, 2013, the victim recognised the accused. Meanwhile, on September 3, 2013, another victim was discovered.

On July 31, 2013, a 19-year-old telephone operator reported a gang rape by five suspects at the same Shakti Mill premises. Three of the five had previously been detained in connection with the gang rape of a female journalist. The Mumbai Police Crime Branch Unit has been tasked with investigating these instances.

The Mumbai Crime Branch filed a 600-page charge sheet against the defendants in court on September 19, 2013. The case's trial started on October 14, 2013. Meanwhile, the accused had been named in court by the victim and the witness. The Mumbai Sessions Court condemned three of the defendants to death and the remainder to life imprisonment on April 4, 2014. The three defendants who were engaged in the gang rape of a female photographer and a telephone operator were sentenced to death.
