ACB to move High Court in the case against AAP MLA SK Bagga

The Anti Corruption Branch of the Delhi's government has decided to move to the High Court against the Assembly speaker Ram Niwas Goel for declining the prosecution sanction against AAP MLA SK Bagga in a corruption case.

MLA Bagga from krishna nagar in east Delhi has been accused of seeking bribe from AAP worker Raju Sachdeva on multiple pretexts on different occasions. In the complaint filed dated on November 9, 2015, Raju Sachdeva  has alleged that Bagga took Rs 11,000, 21,000, and Rs 25,000 from him on many occasions and Bagga has promised him of a ticket from AAP in the MCD elections 2017. 

Chief Minister Arvind Kejriwal has brushed away the matter and refused to take any action against Sachdeva even after listening to all the strong evidences in the form of call recordings where it can be clearly heard that Bagga was demanding a sum of Rs 5 lakh as bribe. In the complaint he provided all the audio call recordings to Arvind Kejriwal on 6th November, 2015.   

Sachdeva however has also given the call recordings to the Chief Minister, but he haven't take any actions against him even after the proofs. The FIR has been registered under the section 7/13 of the Prevention of Corruption Act and section 506 (criminal intimidation) of the Indian Penal code on March 9, 2018, after he handed the recordings to ACB.   
 

In further discloser in November 2015 it came under light that Bagga told Sachdeva to orgainse a diwali function at Gandhi Park in New Govindpura and promise him that chief minister will be the guest their. For which Bagga demanded Rs 5 lakh for ensuring CM presence their at the event. "As Sachdeva did not pay the demanded Rs 5 lakh, Bagga refused to get Kejriwal as the chief guest" as per the claims. 

During the investigation both the voice samples have been taken by the ACB and further send to FSL, Rohini for examination. In the reports FSL has confirmed that the audio recordings were genuine and Bagga's voice has also matched with the recordings. 

"Goel, in complete and blatant disregard of evidence verified substantively by the Forensic Science Laboratory (FSL), sweepingly left Bagga off the hook by resorting to a partisan and questionable personal 'wisdom'" as per one of the official source. 

On 23rd March, 2022, ACB has sought the permission of assembly speaker for prosecuting Bagga under the corruption act to which goel said that request citing the facts do not disclose any offence under section 7/13 of prevention of corruption act and declined the sanctions to the prosecution in this case. Lt Governor V K Saxena has now grant his approval to preceed with the filing of appeal in the court against the denial of prosecution sanction.
