Earlier, Notice has been posted on Atul Rai's house. Earlier, the Supreme Court had categorically refused to stay the arrest of BSP MP Atul Rai from the Ghosi Lok Sabha seat of UP.  After the court's decision, Atul Roy withdrew his petition. He had filed an anticipatory bail petition in the case.

Atul Kumar Rai has been booked by a young girl from Ballia in several sections including rape, cheating and threatening. The girl has lodged an FIR against Atul Kumar Rai at the Lanka police station in Banaras. According to the FIR, Atul Rai took the young woman to an apartment in Lanka and raped her. The girl has also accused her of pressuring her to keep her mouth shut after the rape incident.
