Delhi High Court: 'False complaint of sexual harassment may put person in trouble'

The High Court has expressed its displeasure over the tendency to file fake cases of sexual harassment in a small dispute. The court said that now is the time to investigate against those who have filed false cases to solve their other person's motive. The court also said that sexual abuse is a serious crime and such accusations are tarnishing someone else's reputation. While making the above comment, the court quashed the FIR registered in view of the agreement between the two sides, but a fine of Rs 30,000 has been issued on the complainant. Justice Subramanian Swamy said in a judgment on 23 February that it is a high example of how the misuse of Section 354 and other related sections of the Indian Penal Code is misused. The court said that how the woman in the parking dispute in the case should file a case against the other party on May 12, 2017, under sections 509,506, 323, 354A.

Now both the parties have come to the court to get the case quashed, with the argument that their friends and family members have got it settled and they realize their mistake. As the court said, it has become a practice to file a case of sexual harassment to force a party to withdraw the complaint initiated against them or to intimidate the party. In such a situation, the reputation of the person concerned would deteriorate and it becomes impossible to be repaid. Apart from this, students are accused in many cases. The court said that sexual harassment or exploitation is a serious offense and filing false cases is an abuse of law.

At the same time, the court told that it is also true that there is a lot of shortage of police force and the police wastes time in the investigation of such false cases, he has to appear in the court hearing too. Further, it has been said that at the moment both sides have agreed and they do not want to remain in a cordial environment as a neighbor. In such a situation there is no justification for prosecuting. Hence, they cancel the FIR lodged in the case. The court said that the time of the police, in this case, has been spoiled. They are warning the complainant not to file false cases like this in the future. The court has directed to deposit this amount in the Delhi High Court Bar Association Social Security Welfare Fund while fining the petitioner Rs 30,000.
