Delhi High Court reprimands municipal corporation 'Salaries and pensions are...'

New Delhi: The Delhi High Court on Wednesday lashed out at municipal corporations for not paying salaries and pensions to employees. The court said lack of funds cannot be an excuse and the right to get a salary is a fundamental right under the Constitution of India. A bench comprising Justices Vipin Sanghi and Rekha Palli was hearing a plea seeking not paying salary and pension to Delhi municipal corporations, particularly employees of North Delhi Municipal Corporation (NDMC) and East Delhi Municipal Corporation (EDMC).

The court further said that the paucity of funds has been reported due to non-payment of salaries at the moment. These cannot be an excuse because salaries and pensions are a fundamental right of the people. The court said that non-payment of salaries under section 21 of the Constitution will have a direct bearing on the quality of life of the people. The court further said that it is imperative that salaries and pensions be paid to employees and retired employees of corporations, including doctors, paramedical staff, and health workers, and who were also serving in the epidemic.

The court further said that the shortage of money cannot be an excuse nor should it be accepted. Payment of salary and pension has to be given priority over other expenses.
