New Delhi: Economically Weaker Sections (EWS) will get the benefit of 10 per cent reservation or will it be banned? The matter is going to be heard again in the Supreme Court. A five-judge bench headed by Chief Justice (CJI) DY Chandrachud will hear review petitions challenging its verdict on May 9. Let us tell you that by making the 103rd amendment in the Indian Constitution, the central government had made a provision of 10 percent reservation for EWS in 2019. At that time the apex court had also upheld the validity of the amendment.

Significantly, the 103rd amendment of the Indian Constitution gives 10 percent reservation to the economically weaker sections ie EWS in government jobs and educational institutions. In November last year, the Supreme Court had upheld 10 per cent reservation for EWS with a majority of 3:2. 3 out of five judges gave a decision in its favor and said that this amendment does not violate the law.

Clause 6 of Article 15 and Article 16 of the Constitution, in which the provision of EWS quota was added, provides 10 percent reservation to the EWS class in government jobs and educational institutions. During the hearing held in November 2022, the top court had considered whether the amendment made by the Central Government had violated the limit of 50 percent? However, later Justice Maheshwari said in his judgment that EWS reservation violates neither the basic structure nor the equality code.
