HC strikes down amendments to Karnataka Police Act, 2021

Bengaluru: The Karnataka High Court on Monday declared the modifications to the Karnataka Police Act, 2021, prohibiting online gambling to be "unconstitutional." Nothing in the verdict, ruled a division bench led by Chief Justice Ritu Raj Awasthi and Justice Krishna S Dixit, should be understood to impede proper legislation in conformity with the Constitution.

Certain portions of the Karnataka Act number 28/2021, to the degree that they control online gaming operations, were held to be ultra vires to the Indian Constitution by the bench.

"The provisions' repeal will have the following repercussions. Nothing in this ruling, however, shall be read to exclude the passage of appropriate legislation on the topic of betting and gaming, in conformity with the constitution's provisions. A writ of mandamus is issued, prohibiting the respondents from interfering with the petitioners' online gaming business and related activities "The bench remarked.

By altering the Karnataka Police Act, 1963, the state government made it illegal to play games of skill, including internet games, for money or otherwise. The petitioners stated that games like poker, chess, rummy, and fantasy sports are all games of skill, and that successive court judgments have categorically distinguished games of chance from games of skill.
