Historic Verdict: Girl Jailed for False Rape Accusation, Innocent Youth Acquitted

Lucknow: In a landmark verdict, the court of Judge Gyanendra Tripathi in Bareilly, Uttar Pradesh, acquitted an innocent youth falsely accused in a rape case. Simultaneously, the court sentenced the girl who made the false allegation to four years, six months, and eight days of imprisonment, equivalent to the period the youth spent in jail. Additionally, the girl has been fined Rs 5,88,822.47 as compensation for the youth's time spent in custody.

 According to ADGC Crime Sunil Pandey, the girl's mother filed an FIR alleging rape on September 2, 2019, at Baradari police station. The accused, Ajay alias Raghav, a resident of Nekpur Subhashnagar, Bareilly, and his daughter used to work together in making tableaux. The allegation was that Ajay had abducted his daughter on August 29, 2019. The police registered an FIR and recovered the girl. In her written statement, the girl accused Ajay of feeding her intoxicating prasad, abducting her, and raping her in Delhi.

Ajay was arrested and remained in jail without bail. The trial was conducted in the court of fast track judge Nishod Kumar. The girl initially gave a strong statement against Ajay on October 13, 2023. However, during cross-examination on February 8, 2024, she retracted her statements, claiming illiteracy and police pressure. She confessed that Ajay had not raped her and that she had signed the written statement under duress.

Upon the girl's retraction, Judge Nishod Kumar ordered her immediate arrest for giving false testimony under oath. A case was filed against her, and she was taken into judicial custody. Subsequently, she was presented in the CJM court and remanded to judicial custody. This verdict marks a significant step in ensuring justice for false accusations and upholding the dignity of the judiciary system.
