Kulbhushan Jadhav case: India rejects Pakistan's condition to grant access to counciler

NEW DELHI: India has rejected the condition of the councillor access of Kulbhushan Jadhav, an Indian national imprisoned in Pakistan. According to sources, Pakistan had given conditional councillor access, which India had objected to. India has categorically refused to accept any conditions for the councillor access to Kulbhushan Jadhav.

It is worth mentioning here that after the International Court of Justice (ICJ) order, Pakistan had promised to grant the councillor access to Kulbhushan Jadhav. Kulbhushan Jadhav, who was jailed in Pakistan, was believed to have access to the council today (Friday), but Pakistan offered conditional concealer access to Kulbhushan Jadhav, which was rejected by India.

According to Article 36 of the Vienna Convention, when a foreign national is arrested, it is mandatory to grant the detainee conciliatory access (diplomatic access) while being under investigation and custody.  Pakistan, on the other hand, had argued in the ICJ that the arrest of a person in espionage did not require that he be granted co-ordinator access. The ICJ had directed Pakistan to stay Jadhav's execution and give him diplomatic access.
