Opposition uproar over Citizenship Bill, accused of ignoring constitution

Most of the opposition parties in the Lok Sabha strongly opposed it, calling the Citizenship Amendment Bill (CAB) against the basic structure and spirit of the Constitution. Opposition parties led by the Congress said that the government is going to create a new gap of division on the basis of religion through this bill for its political agenda. Amid tremendous political heat, the Opposition also warned the government that the Citizenship Bill passed against the spirit of Article 14 of the Constitution would not stand the test of the Supreme Court.

According to media reports, Congress MP Manish Tiwari, while initiating the discussion on the Bill in the Lok Sabha, said that the Citizenship Amendment Bill is not only unconstitutional but also unethical as it is also against the spirit of Baba Saheb Ambedkar's constitution. He said that it is natural to rage against this bill as it is against Articles 14, 15, 21, 25 and 26 of the Constitution. Government or state cannot discriminate against any person on the basis of religion or sect. But the existing legislation is differentiating on the basis of religion because it excludes the Muslim community. The Congress leader said that this law is not secular and therefore against the preamble of the Constitution.

In his statement, the Congress leader, citing several important decisions of the Supreme Court, said that if any refugee seeks refuge on humanitarian grounds, we cannot deny it on the basis of religion. While requesting the government to remove the shortcomings of the bill, he said that the Congress is against infiltration. That is why the government brought comprehensive legislation related to infiltration and refugees, but their party cannot support this bill which creates religious discrimination. Manish Tiwari also rejected the allegations of Home Minister Amit Shah of holding the Congress responsible for the partition of the country. He said that in 1935, the leader of the Hindu Mahasabha, Veer Savarkar, had brought the proposal for two-nation for the first time.
