Supreme Court will hear on Tuesday the plea of Mukesh, convicted of the gang rape case on December 16, 2016, in the capital Delhi. Mukesh has challenged the President's order to dismiss the mercy petition. He also demanded a moratorium on the death warrant of 1 February. It is another matter that the President's decision on mercy petition is considered final, despite this Mukesh has filed a petition to the Supreme Court requesting mercy to avoid hanging.

According to the media report, The bench of Justice R.K. Bhanumathi, Justice Ashok Bhushan and Justice AS Bopanna will hear at 12.30 pm. Mukesh has said in his petition that the President did not consider the mercy petition properly and dismissed it in a hurry. The Supreme Court dismissed Mukesh's curative petition on 14 January. The curative petition of Vinay was also rejected. After the curative petition was dismissed, Mukesh sent a mercy petition.

Mukesh's lawyer on Monday referred to the petition before the bench of Chief Justice SA Bobde and requested for an early hearing on the case. To this, the bench remarked, "If someone is going to be hanged, nothing could be more important than this. The hanging case will be given top priority." Later in the Supreme Court's agenda of January 28, released in the evening, Mukesh's petition was included for hearing.
