On January 17, the lower court had issued a death warrant against the convicts Mukesh Kumar Singh, Pawan Gupta, Vinay Sharma, and Akshay Kumar for a second time. However, on the death warrant issued for February 1 on the plea of the convicts, the lower court had stayed till January 31 next order. The Home Ministry challenged the decision to put stay on the death warrant in the High Court, alleging that the guilty are misusing the law. In such a situation, there should be no further delay in the hanging of Nirbhaya's culprits for the benefit of society and law. The advocate of the convict had argued that till the completion of the legal process of all the culprits, the execution should not be done and all should be allowed to complete the legal process.
