Petition seeking removal of election symbol from EVM dismissed in SC, CJI said this

New Delhi: The Supreme Court on Tuesday dismissed a plea seeking the removal of the election symbol of political parties from electronic voting machines (EVMs). Meanwhile, the apex court, while disposing of the petition, has allowed the petitioner to place his demand before the Election Commission. On this, the election commission's lawyer has said that if any such case comes to the commission, they will look into it.

During the hearing, Chief Justice (CJI) UU Lalit asked how a person would represent his political party when he becomes a candidate of a political party. Senior advocate Vikas Singh, appearing for the petitioner, argued that if a candidate is seen by a voter, there will be better people in the system. The party will be forced to give tickets to better people. It is done in Brazil, which has no symbol. So that voters go and vote only on the basis of the candidate, not in the name of the party. 

Advocate Vikas Singh further said that if the party symbols are removed, voters will also try to know about the person they are voting for. On this, the CJI said that you are saying that the use of party symbols is not constitutional. In response, the lawyer said that the voter should get an informed choice and vote on the basis of credibility and not on the basis of party. Senior advocate Gopal Sankaranarayanan said, "We are seeking a direction from the Election Commission. On this, the CJI questioned on what basis are you doing this. To this, advocate Vikas Singh replied we are doing this on the basis of Articles 14 and 21.''
