New Delhi: The Supreme Court of India has challenged the provision of contempt of court. Challenging this provision, the court said that this system is against the basic structure of the Constitution. Those challenging the contempt of court include senior advocate Prashant Bhushan of the apex court, former journalist N. Rama and former Union Minister Arun Shouri. The petitioners have demanded from the apex court that the Supreme Court repeal certain provisions of the Contempt of Court Act 1971.
It is noteworthy that a contempt action is going on in the Supreme Court against him on a tweet by Prashant Bhushan. The Supreme Court has taken contempt proceedings taking automatic cognizance of some of Bhushan's tweets. Now Prashant Bhushan, N Rama, and Arun Shouri have challenged the provision of contempt of court in the apex court. This petition has been filed under section 32 of the constitution. This petition is also called the soul of the Constitution. Under Section 32, the right to apply in the Supreme Court has been given by appropriate proceedings to enforce the fundamental rights found in the Constitution.
This petition challenges the constitutional validity of section 2 (c) (i) of the Contempt of Court Act 1971 and calls it a violation of Article 19 and Article 14 of the country's Constitution.
