'RSS’s Path Sanchalan to take place across TN', HC allows

Chennai: The Madras High Court has given an important decision regarding the Path Sanchalan of the Rashtriya Swayamsevak Sangh (RSS) in Tamil Nadu. The court has ordered the Tamil Nadu police to allow the union to conduct Path Sanchalan across the state. Earlier, the single judge had not allowed the union to take out Path Sanchalan from public roads. The court had directed the RSS to conduct Path Sanchalans at the ground or stadium. This decision was challenged by the RSS.

The Madras High Court heard a petition filed by the association against the single judge's decision. During the hearing, a bench of Justices R Mahadevan and Mohammad Shafiq ruled in favor of the RSS, citing citizens' right to freedom of speech and expression. The High Court directed the RSS to re-apply for the Path Sanchalan on three different dates. The court directed the Tamil Nadu Police to give permission for the Path Sanchalan to be taken out in different districts of the state. The court said that the police should allow the Path Sanchalan to be taken out on any date by the RSS. Earlier, permission was sought by the Sangh for rallies and Path Sanchalan at 50 places. On November 4, 2022, the High Court allowed the RSS to hold events at 44 places in Tamil Nadu with certain conditions. This decision was challenged by the association.

The petition filed by G Subramanium referred to the October 2, 2023 verdict allowing him to take out the Path Sanchalan. Subramanian had also sought punishment of state government officials and policemen for contempt of court. Earlier, the Hindu outfit Indu Makkal Katchi-Tamizhgam (IMKT) was also not getting permission from the MK Stalin government and the police to hold the state-level conference. The police had denied permission for the event citing law and order issues. The RSS had then approached the high court. The Madras HC had given permission for the state-level conference held on January 29, 2023. The court had said in its order that there cannot be a complete ban on holding religious gatherings.
