SC rejects ex-BSF jawan Tej Bahadur’s plea against rejection of nomination

New Delhi: The Supreme Court on Thursday dismissed the plea of sacked Border Security Force (BSF) jawan Tej Bahadur Yadav challenging the Election Commission’s decision to scrap his Varanasi nomination for Lok Sabha polls.

Rejecting the plea, the SC  said it cannot interfere in poll panel’s decisions beyond a point. Chief Justice Ranjan Gogoi said, “We did not find merit in the plea. Beyond a point, we cannot interfere with the Election Commission’s decision.”

Tej Bahadur had filed his nomination from Varanasi, which is Prime Minister Narendra Modi’s constituency, as a candidate of the Samajwadi Party. Lawyer Prashant Bhushan, appearing for Tej Bahadur, said his client was being harassed for complaining about food when he was in BSF.

Bhushan alleged that “There is more to it than meets the eye… my client is being harassed for complaining about the food. They are angry and revengeful as he has exposed something.”

In his plea, the former BSF trooper argued that the Returning Officer of Varanasi had "completely failed" to appreciate the fact that he had produced his dismissal letter along with his nomination papers.

After his nomination was rejected by the EC, Tej Bahadur had alleged a conspiracy to keep him out of the contest in Varanasi to ensure PM Modi's easy win.

last week, the Samajwadi Party had replaced Shalini Yadav with Tej Bahadur Yadav to contest against Prime Minister Narendra Modi from Varanasi.
