SC Halts Calcutta High Court Proceedings in Medical Admissions Case

NEW DELHI: In a major development, the Supreme Court, led by Chief Justice of India D.Y. Chandrachud, intervened on Saturday to suspend all proceedings related to a medical admissions case at the Calcutta High Court. This move comes amid a public disagreement between two judges of the Calcutta High Court over the matter.

The apex court also put a hold on the orders issued by Justice Abhijit Gangopadhyay, which aimed to transfer the case to the Central Bureau of Investigation (CBI). Additionally, the Bench issued notices to West Bengal, the CBI, and the petitioner involved in the High Court proceedings.

Moreover, the State government has been granted permission to file a separate special leave petition challenging Justice Gangopadhyay’s orders. Meanwhile, the Centre has been allowed to circulate a note regarding the case.

During the proceedings, Attorney General R. Venkataramani and Solicitor General Tushar Mehta raised concerns about the procedure followed by the High Court Division Bench. They questioned the decision to stay Justice Gangopadhyay’s directives without thoroughly examining his judicial order, case records, or the appeal memorandum.

The five-judge Bench clarified to both the State government and the Centre that it refrains from making any preliminary comments at this stage. The case has been scheduled for further hearing on January 29, 2024.
