Mumbai: Shinde faction MLA Sanjay Shirsat has attacked the Thackeray faction. He has said that Uddhav group will merge with Congress. Shirsat has said that we have not formed any group. We are the real Shiv Sena. We have taken the decision as per the rules. The Election Commission also considered us as Shiv Sena. Not only this, the court also did not stay the decision of the Election Commission. Soon the Thackeray faction will merge with Congress.

Shiv Sena's 2018 amended constitution is not in the records of the Election Commission - Assembly Speaker: Not only this, while giving the verdict in the case of disqualification of Shiv Sena MLAs, Maharashtra Assembly Speaker Rahul Narvekar has said that both the factions (two factions of Shiv Sena) have submitted a petition to the Election Commission. There is no consensus at all on the submitted Constitution. The two parties have different views on the leadership structure. The only aspect is that of majority. I have to decide the relevant constitution keeping in mind the leadership structure that existed before the dispute. He has said that the amended Constitution of 2018 is not in the records of the Election Commission. Only the 1999 constitution of Shiv Sena is valid. Even in the records of the Election Commission, Shinde faction is the real Shiv Sena.

Shiv Sena's 1999 Constitution is supreme: While announcing the decision on the disqualification of 16 MLAs, Assembly Speaker Rahul Narvekar continued his point and said that Shiv Sena's 1999 Constitution is supreme. We cannot accept their amended Constitution of 2018. This amendment is not in the records of the Election Commission. During this time he also raised the issue of elections in Shiv Sena's organization. He has said that there are no elections in the organization in the year 2018. We also need to keep in mind the organizational leadership of 2018. He has also said that I have a limited issue and that is who is the real Shiv Sena. Both the groups are also claiming to be genuine.

Maharashtra Assembly Speaker Rahul Narvekar has said that Shiv Sena's 2018 amended constitution cannot be considered valid as it is not at all in the records of the Election Commission of India. As per the record, I have taken into consideration the 1999 constitution of Shiv Sena as the valid constitution.

Maharashtra Legislative Assembly Speaker Rahul Narvekar has further said that as the Speaker, I am exercising jurisdiction under Section 10. The jurisdiction of the Schedule is limited and cannot go beyond the records of the ECI available on the website and hence I have not yet considered this aspect while determining the relevant leadership structure.

The decision to remove Shinde should have been taken by the National Executive: The Assembly Speaker has further said that according to the party's constitution, Chief Minister Shinde cannot be removed by the Uddhav group. There is no post of party chief left in the Constitution. Also, there is no provision in the Constitution to remove the leader of the legislative party. He has said that the decision to remove Shinde should have been taken by the National Executive. The stand of the Uddhav group on the National Executive is not clear. Along with this, the Speaker has declared the executive proposals of June 25, 2022 invalid.

Shinde faction is the real Shiv Sena: Assembly Speaker Rahul Narvekar has also completely rejected Uddhav's argument of the real party. While concluding, he said that when the rebel group was formed, at that time Shinde group was the real Shiv Sena. This decision of the Speaker has dealt a big blow to the Uddhav faction.
