State breaches secularism, Love Jihad laws, civil liberties

With increased Love Jihad in India, many state Government are in discussion to pass law against 'Law Jihad'. However, the civil liberties informs the state government interfering in Love and Marriage issues are against secularism. A common law says when a woman married a foreigner, she would assume the nationality of her husband. In India, the word Nationality has been replaced with Religion. India which has given freedom of either to be religious or not to be. With this point, the State trying to decide if a "conversion" is valid or not is deeply problematic. 

The Hindu marriage law is different from Muslim and Christian laws, it has its own requirements about the faith of the parties. The root of controversy about conversion arises at this point. The Allahabad court which in the month of October ordered that the conversion would not be bonafide if it was only done to remove a legal disability to go ahead with a marriage and the same court overruled its order and said whether the conversion was valid or not is immaterial to deciding the right of two people to live together safely leading the states proposing 'Love Jihad Laws'. But the broader question lies will these laws achieves its objective of stopping so called 'Love Jihaad'. 

The Goa Inquisition, in Portugese India examine the party and put questions to them on matters touching upon their conscience to carry out conversion has to be followed again. Civil Liberties asks the State that there is no respect of religions under our Constitution, the State remains secular, then what is the State's interest in ensuring that a conversation is "valid". A simple Love Jihad law is a blatant assault of civil liberties at the most fundamental level. People suggest separate Secularist laws for inter faith marriage which does not comes under any religious laws and allow person to stay in same faith as before marriage and allow their children to choose theri religion after 18.
