Subramanian Swamy Files PIL in Delhi HC, Seeks Cancellation of Rahul Gandhi's Indian Citizenship

New Delhi: BJP leader Subramanian Swamy has filed a Public Interest Litigation (PIL) in the Delhi High Court, requesting the Ministry of Home Affairs (MHA) to act on his petition to revoke the Indian citizenship of Congress leader Rahul Gandhi, who also serves as the Leader of Opposition (LoP) in the Lok Sabha.

As per reports from Bar and Bench, Swamy had initially reached out to the MHA with this demand back in 2019. Represented by advocate Satya Sabharwal, Swamy’s concerns are based on documents from a UK-based company called Backops Limited, which was established in 2003.

Swamy alleged that Rahul Gandhi was listed as both a director and secretary of Backops Limited, and that the company's annual filings on October 10, 2005, and October 31, 2006, recorded his nationality as British. Additionally, Swamy pointed out that even in the company’s dissolution documents, filed on February 17, 2009, Gandhi’s nationality was again noted as British.

Swamy remarked, this issue breaches Article 9 of the Indian Constitution as well as the Indian Citizenship Act of 1955. Article 9 states that a person cannot be considered an Indian citizen if they have voluntarily obtained citizenship in another country.

Swamy took to social media platform X (formerly Twitter) to explain the situation, stating, “My Associate Advocate Satya Sabharwal has filed a PIL on the Home Ministry’s inaction in prosecuting Rahul Gandhi and not stripping him of his Indian citizenship. Rahul Gandhi has failed to respond to the Ministry, which prompted the PIL. I also extend my thanks to Associates Vishesh Kanoria."
