New Delhi: The Supreme Court has summoned the Secretary (Home) of UP on Monday 16th September in a case challenging the cancellation of the marriage of a minor Muslim girl from Uttar Pradesh and sending her to Nari Niketan. The apex court is upset with the UP government not responding to a petition of a minor Muslim girl seeking to be sent to her husband. The apex court has asked the UP Home Secretary to appear in person on Monday.

In fact, the Allahabad High Court ruled the marriage of a 16-year-old girl illegal and ordered her to be kept in Nari Niketan. According to Islamic law, a girl at the age of 16 is considered eligible for marriage. So she has the right to marry. The minor Muslim girl has requested the Supreme Court to declare her marriage valid before the prescribed constitutional age of marriage is 18 years on the same basis.

On this, the top court had also given consent for hearing. In the previous hearing, a bench of Judge NV Ramana, Judge Indira Banerjee and Judge Ajay Rastogi, while hearing the application filed in the case, issued a notice to the UP government and asked them to respond. The bench asked the UP government why the petitioner girl should not be allowed to lead a married life, while the Allahabad High Court had annulled the marriage.
