New Delhi: The largest court in the country has taken action on the petition filed on Thursday against the Anti-Defection Law. The Supreme Court has issued a notice to the Election Commission and the Central Government regarding the petition. The petition filed by the Congress leader sought to prevent the disqualified MLAs from contesting the by-election during the tenure of the House.

A bench headed by Chief Justice SA Bobde has sent a notice to the government and the Election Commission. The court has sought answers from both of them within four weeks. In this petition, Congress leader Jaya Thakur has mentioned the recent political events in which members of the assembly resign and the government collapses. After which they again emerge as ministers with the government formed by the opposing party.

The petition states that "Once a member of the House is disqualified under the 10th Schedule, he cannot be allowed to contest again during the tenure of the elected." During this time, the petitioner has referred to the political events of Karnataka, Madhya Pradesh, and other states, saying that even an MLA who voluntarily resigns, falls under the purview of a party change law and should be disqualified. It is clear in the schedule that the disqualification of becoming an MP or MLA continues for a full 5-year term of a certain House.
