Supreme Court issues guidelines on 'Maintenance Allowances' in marriage cases

New Delhi: The country's largest court has issued a detailed guideline regarding the payment of alimony of the victim in marital disputes. After going to the court of dispute, both the parties will have to give complete information about the income source and their individual income. Only after this the amount of alimony will be determined. The Supreme Court has decided in its decision that the High Court will also execute the same.

In the Supreme Court, Justice Indu Malhotra and Justice Subhash Reddy in its important judgment have elaborated on various aspects of the guideline, that is, the status of interim alimony payments and other aspects are also cleared during the continuation of the hearing of the dispute. According to the guidelines, the Supreme Court will now have to give details of their income and assets from the date on which the application for maintenance allowance is made. Along with this, till the income and assets are not disclosed, the process of arrest or sending to jail will be stopped till we do not give alimony.

Justice Indu Malhotra and Justice Subhash Reddy on Wednesday ensured that the spouse has to make alimony payments. According to the rule, both parties should disclose their income and property in the court, but in many cases, the affidavit was filed and discharged. After the new guidelines of the apex court, the party claiming alimony will be quite comfortable. The decision will provide relief to the spouse who has claimed alimony, but if the maintenance allowance is not given in time, it can also lead to jail.
