New Delhi: Justice Rohinton Foli, the second most senior judge of the Supreme Court, who has given several major verdicts, including triple talaq, is retiring on Thursday. He had decided to repeal Section 66A of the IT Act. His other decisions include LGBT rights, fundamental rights to privacy, the decision to end triple talaq.

He was recommended by the Central Government on July 7, 2014, to directly make him a Judge of the Supreme Court from a senior lawyer. With his retirement, the issue of vacancies will once again come up in the spotlight. Karnataka High Court Chief Justice Abhay Oka is ranked No. 1 in the seniority list, followed by Tripura High Court Chief Justice Akil Qureshi. Justice Oka's parent is HC high court, Bombay, while Justice Qureshi is from the Gujarat High Court. After Justice Nariman's retirement, the Supreme Court will have only 25 judges against the sanctioned power of 34 judges.

With this, Justice Naveen Sinha is scheduled to retire on August 19, after which the number of vacancies in the apex court will reach 10. The last appointment to the apex court was in September 2019 and the first vacancy came in November 2019 when former CJI Ranjan Gogoi retired. This week, Justice Nageshwar Rao will replace Justice Nariman in the collegium and a new attempt to reach a consensus is likely to begin.
