New Delhi: The apex court has said that the name of the rape victim should not be mentioned in any proceedings in all the courts. Lower courts should be careful while dealing with such cases. The Supreme Court passed the direction expressing displeasure over a sessions court's decision in Chhattisgarh to mention the name of the rape victim.
A bench headed by Justice Ashok Bhushan said that it is fully established that the name of the victim should not come up in any action in such cases. The court said that we express displeasure over the sessions judge's decision where the name of the victim has been mentioned. The court said this in its order and dismissed the petition filed by the convict. The petition had challenged the Chhattisgarh High Court's decision to convict him in the rape case. The bench said that as per the facts of the case, we do not want to hear this special leave petition.
The high court in its December 2019 judgement had dismissed a petition filed against the lower order convicting him in the rape case. The person was convicted by the Sessions Court of Mahasamund in the case registered in 2001. The high court upheld the lower court's order saying that based on the statements and evidence of the victim, it can be said that it is not a matter of consensual physical relations.
