New Delhi: The Supreme Court has made a big comment on the right of the disabled. The apex court said that employment opportunities should be provided to differently-abled persons not as sympathy but as a right to them. A bench of justices Bhanumati and AS Bopanna made the remarks while dismissing an order of the Rajasthan High Court.

The Rajasthan High Court had directed its administrative part to consider the application of a candidate for appointment to a post of civil judge reserved for persons with disabilities, who, despite being disabled, had shown themselves as a general category in their application. The applicant, Neetu Harsh, was visually impaired. Despite this, she had also succeeded in the main examination and subsequent interviews as a general category candidate.

She had not submitted her disability certificate during this period. Neetu was at number 137 with 136 points when the results were announced. However, another disabled candidate finished 57th with 138 points, relative to the two vacancies reserved for the differently-abled. Neetu Harsh submitted an application urging her to be placed in the Disabled category.

However, her application was rejected. Neetu Harsh then appealed to the Rajasthan High Court. The High Court, in a sympathetic view of Neetu's application, had directed its administrative machinery to treat her under the Disability Category. But the apex court on Friday dismissed the High Court order.
