New Delhi: The Supreme Court on Tuesday refused to hear a petition filed by Shiromani Akali Dal (SAD) leader Bikram Singh Majithia. It had sought quashing of cases registered against him under the Narcotic Drugs and Psychotropic Substances Act, 1985 on behalf of the Punjab Police.
A bench of Justices DY Chandrachud and Surya Kant asked Majithia to approach a division bench of the Punjab and Haryana High Court seeking relief. The supreme court in its order said, "We are not inclined to consider the petition under Article 32. But we allow the petitioner to approach the High Court or any other bench. We direct that the petition should be heard only by a division bench of the High Court and not by a single bench.''
On January 31, the apex court had granted protection from arrest to Majithia till February 23 in view of the February 20 assembly elections to contest as a Shia candidate from the Amritsar East assembly constituency. He surrendered after the security period ended. Majithia said the cases are motivated by politics. He argues that his investigation has already been done on behalf of high-ranking police officers.
