SC seeks reply from UP govt on Azam Khan's plea

New Delhi: The Supreme Court on Thursday sought a response from the UP government over the compliance of its order staying Samajwadi Party (SP) MLA Azam Khan on a condition related to his bail. The case pertains to the Supreme Court's stay on the condition of the Allahabad High Court relating to Azam Khan's bail. In fact, Azam Khan, in his petition filed in the Supreme Court, had claimed that the said condition was linked to the demolition of a part of his Jauhar University, which was allegedly created by occupying the enemy property. The order for attachment of this land was given by the High Court in the bail condition.

Now SP MLA Azam Khan has alleged that even after the Supreme Court's stay order, the Uttar Pradesh government has not removed the barbed wire fence from the Jauhar University campus, causing problems in its operation. Justice AM Khanwilkar and Justice JB Pardiwala's bench said that the state government should file its reply on the matter by July 19. Thereafter, the court listed the petition for July 22.

On May 27, a vacation bench of the Supreme Court had said that the bail condition imposed by the Allahabad High Court prima facie seemed inconsistent and like a "decree" of the civil court. At the same time, the court had stayed the directions issued by the High Court to Rampur DM to take possession of the land attached to the university.
