Supreme court's big statement on reservation, says 'This is not a fundamental right'

New Delhi: The Supreme Court has given a big statement on reservation while hearing a case on Thursday. This statement has been made by the apex court while refusing to hear the petition filed against the OBC reservation for medical seats in Tamil Nadu. The apex court has said that the right to reservation is not a fundamental right.

In fact, several parties in Tamil Nadu, including DMK-CPI-AIADMK, had filed a petition in the apex court under the NEET for 50 per cent OBC reservation in Tamil Nadu. The petitioner's counsel before the Supreme Court said that we are asking to follow the Medical Council of India (MCI) provisions and not asking the court to give reservation. OBC reservation is not being implemented in the state. During the hearing on Thursday, the apex court said that whose fundamental right has been taken away in this case? From your pleas it seems that you are only talking about the well being of some people of Tamil Nadu. The court said that this is not a matter related to violation of fundamental rights. Article 32 is only for violation of Fundamental Rights. We believe that all of you are interested in the fundamental rights of the citizens of Tamil Nadu.

The court further said that the right to reservation is not a fundamental right. You withdraw the petition from the apex court and file it in the Tamil Nadu High Court. The court said that we are not accepting the writ petition. However, we are not rejecting this and give you the freedom to transfer to the High Court.
