NEW DELHI: In the wake of dismissal of impeachment notice by RS chairman Naidu over CJI Dipak Misra, Congress MPs on Monday challenged rejection of the motion in the Top Court and sought an urgent hearing from Justice J Chelameswar, who had led senior judges in holding a presser against the CJI at present.

With a prompt response, the CJI formed a five-judge bench of Justices A K Sikri, S A Bobde, N V Ramana, Arun Mishra and A K Goel which will hear the petition jointly lodged by two Congress Rajya Sabha MPs -Partap Singh Bajwa from Punjab and Amee Harshadray Yajnik from Gujarat at 10.30am on Tuesday. Entertainingly, the five-judge bench headed by the CJI which has constantly heard petitions challenging validity of Aadhaar for months will not gather on Tuesday.

On a related note the bench headed by Justice Sikri, which will attend to the petition, includes none of the senior judges — Justices Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph — who held a first-time press conference on January 12 laid blame on the CJI Mishra of randomly allocating important cases to “select benches headed by junior judges”.

On Dismissal of impeachment notice, Venkaiah Naidu had said the removal motion did not meet the requirement of “proved misconduct” and has lacke of evidence of wrongdoing.
