WhatsApp group admin not responsible for members’ posts: HC

INDORE: Indore bench of Madhya Pradesh High Court issuing orders on WhatsApp group admin plea said group admin can't be held responsible for content posted by members in a WhatsApp group.

This brought big breather for thousands of group admins across the country as court said that a WhatsApp group admin cannot be held responsible for objectionable comments circulated by other members of the group.

The order was passed by the vacation bench, while granting anticipatory bail to Ramesh Vyas, over a complaint filed by Praful Sharma, a member of the WhatsApp group for which Vyas is the admin.

Vyas, the state president of Life Insurance Agents Federation of India, had moved an anticipatory bail plea, after a sessions court rejected his plea last week.

Petitioner’s counsel Manish Yadav said Vyas terminated membership of Sharma and posted the order in a WhatsApp group of insurance agents.

After the order was circulated, other members abused Sharma, following which he lodged a complaint against Vyas and other office-bearers of the association.
