Wife doesn't need husband's permission for abortion: Kerala HC

Kochi: The Kerala High Court has made an important remark while hearing a case. During this, the court said that if a pregnant woman wants to have an abortion, then she does not need her husband's approval to do so. The court said that there is no provision in the Medical Termination of Pregnancy Act under which a woman has to take permission from her husband to do an abortion. The reason for this is that the woman tolerates the pain and stress of pregnancy and childbirth.

The court passed the order on a petition filed by a 21-year-old woman from Kottayam. In this, the young woman had sought permission to abort according to medical terms. The pregnant woman is not legally divorced or widowed. Justice VG Arun said the woman had no relationship with her husband. Because the young woman had given a criminal complaint against her husband in this regard. It had said the woman's husband showed no desire to live with her. Therefore, the court held that it amounted to a drastic change in her marital life.

Recently, the Kerala High Court bench heard the petition filed by the husband for divorce. The court had observed that the younger generation was looking at marriage as evil. That is why live-in relationships are on the rise, the court said. A bench of Justices A Mohammed Mushtaq and Sofi Thomas made the statement while hearing the divorce petition. To enjoy a free life, people avoid the bondage of marriage and that is why live-in relationships are increasing.
