Lucknow: To check the serious crimes against women in Uttar Pradesh, the Yogi Adityanath government of the state has passed a bill in the UP assembly. Under this bill, now such accused will not get anticipatory bail, who commit atrocities on women and children. According to media reports, this bill, introduced in the Uttar Pradesh Assembly on the initiative of CM Yogi Adityanath, proposes to abolish anticipatory bail for those accused of committing heinous crimes against women.

The bill seeks to amend the provisions of the Code of Criminal Procedure (CRPC). Let us tell you that this bill was introduced by the Yogi government in the assembly on Thursday (22 September 2022). According to the bill, after the amendment, there will be a provision that those accused of serious crimes against women such as rape, gang rape, sexual misconduct will not get anticipatory bail. The accused registered under the POCSO Act will also not get anticipatory bail.

According to the information, the amendment is an attempt to amend section 438 of CrPC and the POCSO Act. While proposing the amendment bill, the Yogi government said that this step has been taken under the 'zero tolerance' policy in crimes against women and children. The Bill states that, in accordance with the policy of zero tolerance to crimes against women and children, to ensure speedy collection of evidence in sexual offences, to prevent destruction of such evidence, to prevent the destruction of evidence. In order to reduce the apprehension and prevent the accused from creating panic among the victim/witnesses, it has been decided to amend section 438 of the Code of Criminal Procedure, 1973.

According to the report, the spokesperson of the state government has said ''The existing law has been made more stringent towards serious crimes involving the rape of women and sexual assault on children. In order to ensure strict action under the Rape and POCSO Act, the sections of the offence related to it have been amended. Now the system of anticipatory bail for the criminals involved in such crimes has been completely abolished.''
