SC refuses to listen to Mustafa's petition, says- High court gave interim order

New Delhi: The Supreme Court has strictly refused to listen to the Special Leave Petition (SLP) of IPS officer Mohammad Mustafa aspiring to become DGP. At the same time, he challenged the decision of the Punjab-Haryana High Court against the order of CAT against the appointment of Dinkar Gupta as the DGP of Punjab. The Central Administrative Tribunal (CAT) rejected DGP Dinkar Gupta's appointment. On 21 January 2020, the Punjab-Haryana High Court had stayed the decision of CAT.

According to the information received, the bench of Justices Sanjiv Khanna and Justice Abul Nazir refused to hear the petition saying that the High Court has given an interim order in the matter at present. Where the hearing on the case is going to be held on 26 February 2020. The Supreme Court asked Mustafa's lawyer PS Patwalia to withdraw the petition. Whereupon he withdrew the petition. On the other hand, the Attorney General of India KK Venugopal and Punjab Advocate General Atul Nanda made it clear that the Punjab government will fight the matter in the High Court and debate it.

In his petition filed in the Supreme Court, Mustafa had mainly questioned the long date given by the High Court for hearing the appeal against the decision of CAT. At the same time, he said that he is going to be relieved in February 2021. According to the Supreme Court's decision in the Prakash Singh case, the minimum remaining tenure of a candidate to be elected as DGP should be six months. Mustafa had said in the SLP that if the dispute is allowed to continue and the petitioner's selection is not considered by August 2020, he may be out of the entire selection process despite being successful before the tribunal.
